CHECKLIST OF REQUIREMENTS FOR PERMISSION OF THE PROPOSED DEVELOPMENT APPLIED BEFORE THE DHSUD
In compliance with existing guidelines of the Department of Human Settlement and Urban Development, the former Housing and Land Use Regulatory Board (HLURB), for property development that may directly or indirectly affect or impact any cultural property. This is in compliance with Section 32 (k) of Republic Act No. 10066, wherein the HLURB is required to coordinate with the commission on matters relevant to the maintenance of the heritage zones and is in connection with the pertinent provisions of the Comprehensive Land Use Plan Guide Book Volume No. 2 and Model Zoning Ordinance on cultural heritage conservation (under special area studies) and Heritage Overlay Zones.
For the purpose of assessment and evaluation of this Commission, the following documents must be submitted
- Application letter addressed to NCCA Executive Director, Eric B. Zerrudo, PhD;
- Special power of attorney for authorized representative, if applicable;
- Photocopy of zoning clearance from the local government unit;
- Sworn statement or barangay certification on existing high-rise building/s within two (2)- a kilometer radius of the proposed building site;
- Location plan or vicinity map indicating all streets and structures within a fifty (50) meter radius from the perimeter of the site subject to development;
- Photographs of the site or structure with respect to its setting;
- As-built plan/s, in case of existing structures within the property that are more than fifty (50) years old;
- Development plans and perspective of the proposed building; and
- Archaeological Impact Assessment duly conducted by a qualified archaeologist/s (if applicable).
Please note that incomplete submittals will not be processed.
After receipt of the complete requirements, it would be endorsed to the National Historical Commission of the Philippines (NHCP) and the National Museum of the Philippines (NMP) for their review, evaluation, and further comments/recommendations.
Once cleared from the NHCP and NMP, a letter of no objection will be released.

CHECKLIST OF REQUIREMENTS FOR PERMISSION OF THE PROPOSED DEVELOPMENT WORK AFFECTING CULTURAL PROPERTIES
In compliance with Section 48b of Republic Act No. 10066 which prohibits the modification, alteration, or destruction of the original features of or undertaking construction or real estate development in any declared or classified cultural properties without prior written permission from the appropriate national cultural agency, including the five meter buffer zone extending from the visible perimeter of the site, we hereby set the requirements for clearances for any developments or interventions directly affecting any cultural properties.
All developments directly affecting declared sites/structures such as National Cultural Treasures, Important Cultural Properties, and Presumed Important Cultural Properties that are works by Manlilikha ng Bayan and National Artists are required to submit the following:
A. For the purpose of assessment and evaluation of this Commission, the following documents must be submitted:
- Request letter addressed to the NCCA Executive Director indicating the background of the development;
- Authorization letter with supporting identification or special power of attorney in cases of representation (if applicable);
- The scope or program of work identifying and detailing the nature and methodology of interventions, should include the reason why such interventions are needed;
- Survey of the current conditions of the property:
- Updated photo documentation of existing site conditions,
- Building/structure geomorphology plan;
- As-built or as-found plans
- Proposed development plans
- Accomplished Philippine Registry of Cultural Property (PRECUP) Form 1
B. Both the as-built or as-found plan and proposed development plans should contain these drawings with complete details according to the scope or program of work of the project:
- Architectural:
- Perspective drawing/s;
- Site Development Plan
- Floor plans;
- Elevations;
- Sections;
- Blow-up details (if applicable)
- Engineering plans (if available):
- Structural;
- Electrical;
- Mechanical; and
- Plumbing.
Please note that incomplete submittals would not be processed. Further, additional documents may be required on a case-by-case basis according to the heritage value of the subject cultural property and the nature of the development.
After receipt of complete documents, it would be endorsed to the National Museum of the Philippines (NMP) and/or the National Historical Commission of the Philippines (NHCP), for dual declaration or overlapping jurisdiction, for their review, evaluation, and further comments/ recommendations
Once cleared by the NMP and/or NHCP, a letter of no objection would be released
CHECKLIST OF REQUIREMENTS FOR NCCA’S POSITION FOR REMOVAL OF PRESUMPTION FILED BEFORE THE NHCP
In compliance with existing guidelines of the National Historical Commission of the Philippines (NHCP) for Petitions for Removal of Presumption as Important Cultural Property for structure fifty years of age or more, in which an NCCA position is required to check if the subject property does possess any cultural heritage value of national significance, the following requirements is set forth:
For the purpose of assessment and evaluation of this Commission, the following documents must be submitted:
- Request letter addressed to the NCCA Executive Director indicating the background of the property and the reason for the filing of the petition;
- Authorization letter with supporting identification or special power of attorney in cases of representation (if applicable);
- Accomplished Philippine Registry of Cultural Property (PRECUP) Form 1 with set of updated exterior a photo documentation of the property and its setting; and
- Copy furnished complete set of documents as required by NHCP’ petition guidelines.
Please note that incomplete submittals will not be processed. Further, additional documents may be required on a case-by-case basis according to the heritage value of the subject cultural property.
A thorough review and evaluation of the property would be made based on the pertinent documents provided and surface research to be done. Further, an in situ inspection can be conducted if the information provided is insufficient; that would be shouldered by the requester or petitioner.
Upon completion of the assessment, the following are the possible outcomes:
- NCCA shall release a position that the subject property does not possess, in any form, cultural heritage value of national significance; or
- NCCA initially finds cultural heritage values of local and/or national significance
subject to further study in the future.
EXPORT PERMIT
An applicant, whether the owner, artist or their duly authorized agent or representative, must submit the following documents to NCCA at least sixty (60) days before the intended export from the Philippines.

- Letter of Intent addressed to the Executive Director, Mr. Eric B. Zerrudo, PhD;
- Accomplished Application Form for Export Permit;
- Certified copy of agreement between the exporting and receiving parties;
- One of the following:
– Photocopy/ies of sales invoices, the numbers of which are in the authorized statement for printing invoices that are approved by the BIR and which were submitted to the NCCA or the National Museum of the Philippines (NMP) by the dealers/exporters of cultural properties duly licensed by the NMP or NCCA; or Notarized Affidavit of Ownership of the items to be exported stating how these items were acquired in the absence of sales invoices;-
– Notarized Affidavit of Ownership or Certificate of Authenticity if the applicant is the artist; - If the applicant is acting as an agent or representative for the artist or owner of the object, the agent must provide a Notarized Special Power of Attorney (SPA) explicitly stating that the artist or owner is allowing him to process the application;
- Certificate of Registration of the cultural properties to be exported previously issued by the National Museum of the Philippines or by NCCA;
- NCCA Board Resolution granting the petition to lift the presumption of Important Cultural Property, if the items for permanent export are works of National Artists and/or Gawad sa Manlilikha ng Bayan (GAMABA);\
- For reproductions of works of National Artists, an affidavit stating the fact that it is a reproduction;
- Colored photograph of each item to be exported or a digital picture through compact disc and hard copy;
- A copy of the passport if the applicant is a foreign national.
